One of the main plaintiffs, Heavy Metal Capital Partners, claims Fitzpatrick solicited a $500,000 investment and promised a guaranteed 120% dividend starting in July 2025. Carbonatik presented itself as owning over 20 mines across Sri Lanka, India, and Tanzania. But investors say the company had not secured any financing or production. They claim Carbonatik later admitted it still needed $1 to $2 million just to begin basic preparatory work.

Fitzpatrick and Carbonatik are denying everything. They are fighting to dismiss the main lawsuit and have also filed their own counterclaims. They are suing the alleged victims for defamation, arguing that they did not actually suffer any harm.
