It looks like Counting On alum Josh Duggar’s legal team is not going to back down on this case. They recently filed motions to seek the dismissal of all child pornography allegations against the TV personality. According to the motion, it asks for the dismissal of two charges along with suppression of evidence. A document obtained by USA Today states that this includes all the statements he made to various investigators.
The documents also state that the investors got a hold of Josh’s phone in the absence of his lawyers. Therefore, according to them, any questioning that happened during that time isn’t valid. In one of the filings, his lawyers argued, “This Court should dismiss this case based on the Government’s failure to preserve potentially exculpatory evidence. At a minimum, this Court should hold an evidentiary hearing to determine what can be determined based on the searches performed and to explore the possibility of alternative remedies.”
Josh Pleaded Not Guilty to Child Pornography Allegations
Josh Duggar, the former 19 Kids and Counting star got caught downloading as well as possessing child pornography. According to some prosecutors, those media files depicted toddlers as victims of sexual abuse. The former reality TV star has already pleaded not guilty. But till his trial, he is in confinement and isn’t allowed to use the internet.
TLC also canceled 19 Kids and Counting after the revelations stating the molestation of Josh’s sisters from his end. Both Jim Bob and Michelle have admitted that their son confessed and apologized for the same. He has also expressed remorse for being unfaithful to his wife Anna and for his pornography addiction.
Counting On: Prosecution Says The Case Is Straightforward
According to the prosecutors, the child pornography allegations against Josh is a straightforward case. Another motion that his legal team filed on Friday suggested that someone could have easily transferred the questionable media to Josh’s devices. However, investigators claim that there is no evidence for the same.
Josh’s trial was supposed to be in July. However, the court postponed it to November 30 after a request for forensic analysis of various devices involved. Just a week after the arrest, they released Josh from prison. Apart from his own kids, he can’t see other minor children. In case of conviction, the former reality TV star might face around 20 years of prison time
and approximately $250,000 in fine. Another scenario could be a possible sentence of up to 40 years.
